The History of the Appeal To Heaven Flag
In 1775, tensions between England and the American Colonies had boiled over into an armed conflict. Taxation without representation, the denial of their rights to a trial by jury, colonists being prohibited from moving west, the gradual eradication of their religious liberties, and other acts of injustice and persecution had broken down their relationships with England. George Washington recognized the need of an American navy to successfully resist British domination of the colonies so much so that he personally financed, commissioned, and sent out the first American naval vessels. Each of the vessels travelled with "An Appeal to Heaven" flags flying at mast.


It Happened To Us - An Appeal To Heaven

The "An Appeal To Heaven" flag became a symbol of the truths stated in our Declaration of Independence, We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable rights

The phrase is from John Locke's Second Treatise of Government, ...where the body of the people, or any single man, is deprived of their right, or is under the exercise of a power without right, and have no appeal on earth, then they have a liberty to appeal to Heaven, whenever they judge the cause of sufficient moment. It signifies the belief mankind's rights and freedoms come from God, no government has the right to infringe upon these rights, and when a government sets upon a course to take these rights, the people have the right to appeal to the King of all kings as their defender in a just and right resistance to tyranny.


For such a time as this, The Constitution of the United States was created.
We the people of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America. Preamble

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; … shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding. Article 6

No person shall…be deprived of life, liberty or property without due process of law…In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved… No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws. Fifth, Seventh, Fourteenth Amendments

But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security. Declaration of Independence

To support the Constitution of the United States and further protect and preserve freedom and justice for all within their borders, state constitutions were also created.

The Constitution of the State of Montana
We the people of Montana are grateful to God for the quiet beauty of our state, the grandeur of our mountains, the vastness of our rolling plains, and desiring to improve the quality of life, equality of opportunity and to secure the blessings of liberty for this and future generations do ordain and establish this constitution. Preamble

All persons are born free and have certain inalienable rights. They include the right to a clean and healthful environment and the rights of pursuing life's basic necessities, enjoying and defending their lives and liberties, acquiring, possessing and protecting property, and seeking their safety, health and happiness in all lawful ways. In enjoying these rights, all persons recognize corresponding responsibilities. Article 2, Section 3

The state shall make law respecting an establishment of religion or prohibiting the free exercise thereof. Article 2, Section 5

Courts of justice shall be open to every person, and speedy remedy afforded for every injury of person, property, or character...Right and justice shall be administered without sale, denial, or delay. Article 2, Section 16

No person shall be deprived of life, liberty, or property without due process of law. Article 2, Section 17

The right of trial by jury is secured to all and shall remain inviolate. But upon default of appearance or by consent of the parties expressed in such manner as the law may provide, all cases may be tried without a jury or before fewer than the number of jurors provided by law. In all civil actions, two-thirds of the jury may render a verdict, and a verdict so rendered shall have the same force and effect as if all had concurred therein. In all criminal actions, the verdict shall be unanimous. Article 2, Section 26

The legislature shall provide protection and education for the people against harmful and unfair practices either by foreign or domestic corporations, individuals, or associations. Article 13, Section 1(2)

The Constitution of the State of Idaho
We, the people of the State of Idaho, grateful to Almighty God for our freedom, to secure its blessings and promote our common welfare do establish this Constitution. Preamble

All men are by nature free and equal, and have certain inalienable rights, among which are enjoying and defending life and liberty; acquiring, possessing and protecting property; pursuing happiness and securing safety. Article 1, Section 1

The right of trial by jury shall remain inviolate. Article 1, Section 7

The exercise and enjoyment of religious faith and worship shall forever be guaranteed; and no person shall be denied any civil or political right, privilege, or capacity on account of his religious opinions; Article 1, Section 4

Courts of justice shall be open to every person, and a speedy remedy afforded for every injury of person, property or character, and right and justice shall be administered without sale, denial, delay, or prejudice. Article 1, Section 18

The distinctions between actions at law and suits in equity, and the forms of all such actions and suits, are hereby prohibited; and there shall be in this state but one form of action for the enforcement or protection of private rights or the redress of private wrongs, which shall be denominated a civil action;...Feigned issues are prohibited, and the fact at issue shall be tried by order of court before a jury. Article 5, Section 1

...and the police powers of the state shall never be abridged or so construed as to permit corporations to conduct their business in such manner as to infringe the equal rights of individuals, or the general well being of the state. Article 11, Section 8

The state of Idaho is an inseparable part of the American Union, and the Constitution of the United States is the supreme law of the land. Article 1, Section 3

The Battle Rages On
Our homeland has been invaded. Our family has been fighting in faith and prayer against tyranny, persecution, and injustice for years. What if it happened to you? Could threats of destroying your career, seizing your entire financial portfolio, and harming your family cause you to forsake your faith, moral conscience and patriotic duty? Ask history how it has worked out in the past. It happened to us and it may soon happen to you. Will you give up your faith or freedom when it does? The giants in the land are big, but God, family, and country are bigger. What shall we then say to these things? If God be for us, who can be against us?

It is time to raise our Appeal to Heaven. Freedom, liberty and justice for all are worth preserving and protecting. Pray and get involved in helping save our homeland. You can make a difference. Never doubt the power of prayer and never underestimate the value of one. No matter what you are going through, God is still on His Throne and nothing is impossible with God.

An Appeal To Heaven
We, the Nickerson Family, appeal to heaven to protect and preserve our family, home, country, and lives.
