This was a punishment, not an eviction or ejectment.
Neighbors offered to store our personal belongings at their ranch, but Clearwater County refused. We requested opportunity to get a stay, but Clearwater County refused. We pointed out the expired writ required the Sheriff to serve us and leave, and that he had not, but Clearwater County ignored their breach of duty. We communicated the Sheriff was acting without a warrant, and the alleged writ, that had never been served, ordered the Sheriff to cause the Defendant, which was us, to remove our personal belongings. No authority was given to him to remove our personal belongings unless we had been given opportunity, and until we failed, to remove them first. Clearwater County told us we were evicted and were not going back on the property or gaining access to our personal belongings. The alleged writ ordered all our belongings to be removed to a safe location. Clearly, all our belongings were not removed and what was removed was handled maliciously, with intent to harm, damage, and injure us, and to purposefully deny us the future enjoyment of our special possessions. We know you should never assign malice where incompetence will do; but the moving of our belongings far exceeded negligence, ignorance, or incompetence. Can you imagine five moving trucks without one moving blanket? Ask yourself, if this case has been going on for years and the judgment was in appeal, why was it so important to raid the property in the freezing rain just before Thanksgiving and Christmas? Why not wait for a good moving day? Why haul our belongings hours away and across county and state lines? Why destroy everything? Why not sell or give the items away rather than rendering them unusable? Why? This was a punishment and another foiled attempt to beat us into submission, to make us walk away from this fight, and let mortgage terrorists get away with all they have done to us and others. Clearly, this was not the restitution of a property to a bank. Anyone who tries to tell you differently should have their motives and loyalties carefully scrutinized to make sure they have clean hands.
